Cloud Solutions in Canada: Where Your Data Is Processed
What Canadian organizations should ask about data location, sub-processors and foreign access when choosing a cloud provider.

Scope of this guide
For cloud services the practical question is where information is processed and who can reach it. This guide covers what the Office of the Privacy Commissioner of Canada says about that. Every rule quoted below was checked against the regulator's own page on 2 October 2026; check the current version before you rely on it. This is general information, not legal advice.
Telling people about processing abroad
The OPC says organizations "must be transparent about their personal information handling practices. This includes advising customers that their personal information may be sent to another jurisdiction for processing and that while the information is in another jurisdiction it may be accessed by the courts, law enforcement and national security authorities." The notice should use "clear and understandable language" and, ideally, be given when the information is collected.
What a contract can and cannot do
The OPC is explicit about the limit: "no contract can override the criminal, national security or any other laws of the country to which the information has been transferred." A contract is still required to provide comparable protection, but it cannot remove foreign legal access, so the location of processing is itself a risk factor.
Questions to ask a cloud provider
- Can data be stored and processed only in Canada, and is that confirmed in writing?
- Which support or engineering staff can access your data, and from which countries?
- Which sub-processors are involved, and in which countries?
- How are requests from authorities handled, and will you be told?
- What does your privacy notice need to say if any processing happens outside Canada?
